“I did not approve or agree to the use of my name or my image on this website,” Rachael Ray said in her statement, which also said she doesn't endorse any acai berry product.

Randall Samborn, a spokesman for the U.S. Attorney's office in Chicago, said the office wouldn't comment on whether it planned to press criminal charges, in keeping with its policy.

Last year, the Better Business Bureau alerted consumers to the company's alleged deceptive practices. At that time, McKenzy told The Associated Press that customers weren't reading the fine print on the company's website when they ordered the sample product.

The FTC's investigation followed more than 2,800 complaints to law enforcement and the Better Business Bureau about the company since 2007.

Because the company does business nationally, the FTC could have filed its lawsuit anywhere in the country. “We chose to sue in Chicago because our Chicago office conducted the investigation and is handling the litigation, and because this scam has victimized many Illinois consumers,” said FTC Midwest Director C. Steven Baker in an e-mail.

Rhonda Wooten, 48, of Paxton in east-central Illinois, said she learned “a hard life lesson” after losing up to $500 trying to stop shipments of weight-loss pills and charges to her checking account.

She had given the company her debit card number after seeing a photo on its website of a supposed satisfied customer, who coincidentally also hailed from Paxton. In reality, Vladeck said, it was a stock photo and the company's software had automatically inserted “Paxton” because it detected Wooten was from there.

“I'm a preschool teacher and they don't make good money, so $200 to $500 is a lot,” Wooten said. “It could buy a lot of food for my kids and my family.”

Martin Elliott of Visa Inc. said consumers should notify the bank that issued their credit card or debit card if they think they've been a victim of fraud. Elliott appeared at the FTC's Chicago news conference.

I recently addressed the reason why weight loss drugs have historically fared quite badly, and in my view are likely to do so for the foreseeable future. Weight gain is normal when calories in exceed calories out on a daily basis. You cannot medicate away normal human physiology — any more than you give a fish a pill to let it breathe out of water.

Now, I would like to pick up the tale where I left off. Because there is more to the story of human weight gain than calories in versus calories out, as not a few of you have stressed in your comments and correspondence. Fundamentally, we are all a lot alike, but also quite a bit different.

The ways we are alike are what I have emphasized so far. It is, indeed, normal for the human body — any human body — to turn surplus calories first into glycogen (a small carbohydrate energy reserve) and then into fat (a much larger potential energy reserve).

And we are all governed by the prevailing laws of physics that relate matter and energy. Calories are a measure of energy, and matter cannot be created without energy input. Arguments against the fundamental role of energy balance in weight regulation — against calories in versus calories out — are arguments with Isaac Newton. Folks, nobody wins an argument with Isaac Newton!

And yet, I believe the innumerable patients I've had over the years who tell me something doesn't quite add up for them. I believe them when they tell me they eat and exercise the same amount as someone else — but they get fat, while the other person stays slim. Or, worse still, that happens even though they eat less, and exercise more. If they are telling the truth- and I am thoroughly convinced they are- doesn't it mean Newton had it wrong?

Nothing of the sort. All it means is that we are different, as well as alike.

While it is true for all of us that weight control is overwhelmingly, if not entirely, about calories in versus calories out, it is equally true that the number of calories required for weight loss, weight maintenance and weight gain vary drastically among us. And we even know why, for the most part.

There are, once we are done growing up, three ways we burn calories: physical activity, the generation of heat and just existing. There are technical terms for the second and third: thermogenesis, and resting energy expenditure (sometimes referred to as basal metabolic rate). What should be noteworthy right away is that you are not in charge of two out of the three!

You can choose how much exercise to do. But you don't get to choose how thermogenic you tend to be, and that can matter quite a lot. Like exercise, thermogenesis accounts for roughly 15 percent of total energy expenditure on average, but there is lots of variation on the theme of average. People who generate more heat from calories have fewer available with which to make fat. They tend to be people who can eat a bit more, and stay thin anyway.

But that's a drop in the bucket compared to resting energy expenditure. Roughly 65 percent of calories are burned to support the fundamental workings of cells and organs that keep us alive. The number of calories burned at rest, and the actual percentage of total calories burned this way, also vary substantially around the average. People with a high resting energy expenditure are, in our modern world of epidemic obesity, the fortunate few most people love to hate: the folks who cannot seem to get enough to eat, and can't put weight on when they try.

If you don't control your thermogenic tendencies, nor your resting energy expenditure — who does? The idiosyncrasies of the genetic hand you were dealt, which are not necessarily idiosyncratic at all.

Take the case of the Pima Indians, for instance.

When the Pimas live a traditional lifestyle and eat traditional Pima foods — mesquite and tepary beans, for example — they have unremarkable health. When they live and eat like everyone else in America, they develop almost universal, severe obesity and diabetes. For a time, the Pimas had the highest rates of obesity and diabetes on the planet, and they are still, alas, contenders for those laurels.

The dire plight of the Pimas resulted in intensive study of them, and it led to both revelations, and the obvious. The Pimas have, uniformly, a very low resting energy expenditure. They are, in other words, highly fuel efficient — even for a fuel efficient species — and it makes perfect sense. The Pimas lived for generations in a harsh desert climate where food was unusually scarce, and physical activity demands unusually high. Pimas who were not highly fuel efficient simply didn't survive long enough to pass on their disadvantage to any future generation of Pimas. (People who don't live to make babies make very poor ancestors.)

Presumably, the variations in metabolic efficiency to which we are all subject can also be traced to variations in the experiences of our ancestors. But for most of us, the magnitude of genetic mixing that has gone on makes those pathways impossible to follow.

So we wind up feeling — those among us who gain weight easily and lose it with extreme difficulty, if at all — that we are enigmas, outcasts, anomalies. We feel that the claim that we can eat less, exercise more, and weigh more nonetheless falls on unsympathetic ears.

Mine are not such ears. I hear you, and I believe you. It is about calories in versus calories out, but the calories required to reach or exceed a personal threshold vary widely, and under influences we neither choose nor control. That isn't fair, but who every promised it would be?

As a practical response to this, I am considering the establishment of a national exchange for the weight loss resistant, so these stories come together and reach a critical volume. I would also like to use it as a means of troubleshooting the problem; many heads will be better than any one. Let me know via email if you would like to join us.

In the interim, I remain unwilling to refute Sir Isaac. But that we are, despite being much the same, quite a bit different — I fully appreciate. I bet Newton would agree; I hope everyone does.

As I was going through the photos from the Teen Choice Awards, one photo of Glee’s Lea Michele popped up, and I was flabbergasted by her sudden and dramatic weight loss. This is not good - AT ALL. As far as I’ve seen, Lea has always been a slender, healthy-looking girl, but CB and I estimate that Lea must have lost about 15 pounds, all within the last month or two. It doesn’t look like a healthy weight loss either, I’m afraid. Her face looks gaunt, her legs are scaring me, and she looks ill.

Apparently, people really began noticing Lea’s weight loss last week, when she showed up for a Fox event looking very tiny. Previously, Lea told the press that: “I’m a vegan. It makes me feel really good and bright. You need a lot of energy to play spunky Rachel Berry, so I’ve tried a lot of different things — and so far, this is working.” Oh, honey. It’s really not “working” if people wince when they see you.

Considering Glee has such a young cast, and they’re really being put the ringer as far as stress and workload, I’ve got to think that somebody high-up on Glee or at Fox is going to say something or do something. Ryan Murphy is the creator, writer and producer of Glee, and I’ve got to think that he’ll be the one to say something to her. Not that just saying something will help, but maybe if she’s encouraged to have a healthier figure and to actually be healthy and eat enough by her boss, it would be a step in the right direction.

What do you get when you combine: 1) a political radical who has been arrested and charged with conspiracy after causing civil disruptions including riots and 2) bureaucratic agencies in California with a record of environmental extremism that are focused on putting in place regulations on businesses that far exceed those set by the federal government?

The answer is massive job loss and industry displacement that satisfies ideologues on the far left and hurts both Americans and the economy.

And that’s exactly what California is confronting concerning the Scientific Review Committee (SRC), which was appointed by the Department of Pesticide Regulation (DPR) to focus on reviewing new pesticides, which also happens to have significant overlap with the Scientific Review Panel (SRP), which is charged with evaluating the risk assessments of substances proposed for identification as toxic air contaminants by the Air Resources Board (ARB), the Office of Environmental Health Hazard Assessment (OEHHA) and the DPR.

You got that? And folks wonder why there is uncertainly in the marketplace and businesses are packing up and heading overseas due to the weight of government.

In California, the SRC is now focused on overturning the state’s decision to approve a new chemical called methyl iodide, which is harmless and does not pose a threat when deployed correctly.

Long story short, methyl iodide is used as a soil disinfectant, and naturally emitted by rice plantations.

The decision to not use methyl iodide seriously threatens a $2 billion dollar a year strawberry industry that employs over 10,000 people alone in California.

The kicker is that the regulations California wants to impose concerning methyl iodide far exceed regulations set by the federal government even after the director of Department of Pesticide Regulation said methyl iodide could be used safely with precautions like respirators, impermeable tarps and extra restrictions on use around schools, businesses and homes.

And the individuals who would bear the burden of these new regulations should they be put in place are family farmers who would be forced to permanently transfer their operations to Mexico and shut down altogether, which wouldn’t be a good thing for California’s economy that is already in free fall.

And that’s where the radical with a history of inciting political unrest comes into the picture.

You see, all one has to do is conduct a quick search of the names of the individuals making up the Scientific Review Committee and Scientific Review Panel and they come across John Froines.

So, who is Mr. Froines?

John Froines is a former member of the “Chicago 7.” Along with his group, Froines disrupted the 1968 Democratic National Convention and was charged with conspiracy for allegedly starting the riots that took place. After his acquittal, Froines gave up his academic career writing, “this resignation is an ultimatum: end this monster or we shall walk over you.”

He decided to dedicate his time to revolutionary causes including “link up with the Black Panther Party … to build a revolutionary movement to end American imperialism.”

But Froines’ best hits don’t stop there…

Froines protested the Vietnam War aligning himself with those “who will be part of the anti-imperialist struggle” comparing the government and corporations to Nazis.

And Froines later found himself – once again – running afoul of the law. He was arrested in March 1971, while marching on Washington and participating in protests that included dangerous acts of vandalism like cutting the fuel lines on buses. And Froines wasn’t just an average Joe civilly expressing his dissatisfaction with government. In fact, authorities allege that Froines was responsible for the disruptions in Washington, organized and planned the protests, including picking “targets for disruption.”

And recently Froines continued to promote his radical views and associate with extremists joining other former “Chicago 7” members – including Black Panther founder Bobby Seale – in 1996 at a reunion in Chicago.

Froines has not taken even one step back from promoting his leftist agenda and controversial past saying, “what happened [in Chicago 1968] had to happen.”

Today, the political extremist with violent tendencies and a penchant for embracing radical orthodoxy is making decisions that affect businesses, which he previously compared to Nazis. Froines’ perch allows him to argue what companies can and cannot do concerning the usage of pesticides in California irrespective if the federal government has already found them to be safe when used appropriately.

The case of John Froines and the Scientific Review Committee and Scientific Review Panel is a case study in how government has a stranglehold on job creation. People like Froines – who are better suited for a jail cell than a government agency – are making decisions that negatively impact all of us by driving business out of the country and impeding any economic recovery both in America and California, which is currently drowning in debt and on the brink of bankruptcy.

Every operating system has its own strengths. Windows is ubiquitous, and offers access to a wide range of software. OSX is rock-solid, and typically behaves exactly as the user expects.

Linux gives you access to millions of open source programs that can’t always be found elsewhere. Many of these free applications are amazingly useful, even for die-hard Windows users. GParted is an excellent example of amazing Linux free partitioning software every Windows user should be familiar with.


Why? Because it’s a complete partitioning tool, in many ways a better alternative to Partition Magic. It supports both NTFS and FAT32 (and much more), meaning it can do everything a Windows user would want to do (and much more!) Finally, because you can run it from a Live CD, you can even edit the partition your primary OS runs on–useful when you want that partition to be larger or smaller.

Best of all, Gparted is free partitioning software that’s already included on the Ubuntu Live CD – a tool I recently argued every Windows user should have anyway.

What Is Partitioning?

In essence, partitioning means splitting your hard drive into different sections. To Windows, each of these “sections” will be seen as separate drives – this despite being physically on the same volume.

What’s the point? Well, if your data is on a different partition than your operating system you can replace your operating system without losing your data. Partitioning is also necessary if you want to run more than one operating system on a single computer – for example, Windows and Ubuntu.

A partitioning tool allows you to shrink/extend existing partitions, as well as create new ones. GParted is just such a partitioning tool.

Another such tool is Partition Manager, a program we’ve featured in the past. While decent, Partition Manager cannot be run from a live CD and as such cannot edit your primary partition.

What Gparted Can Do

Fire up GParted and you’ll see your primary drive, ready to be altered. You can delete a partition if you like, or just resize it. To do something all you need to do is right-click the drive or partition you want to edit. The menu that comes up even features sliders you can drag if entering numbers isn’t quite your style.

Don’t see what you want to edit? Know that, in the top-right corner of the window, is a drop-down menu that allows you to select which drive you want to configure.

It’s also worth noting that GParted won’t do anything until you click the “Apply” button in the toolbar. So if you want to see what kind of configurations will work and won’t work go ahead; nothing is altered until you click okay.

Finally, it’s worth noting that partitioning is not without risks. If, for example, you experience a power outage while partitioning the result might be a system that will no longer boot and data that’s hard to recover. Protect yourself from this by using a battery backup, or by ensuring your power source will be consistent.

It’s also a good idea for Windows-types to defragment their hard drive before partitioning. This will greatly increase the effectiveness of your partitioning.

Getting GParted

If you already use Linux, congratulations: you have easy access to GParted. Check your distro’s repositories to install.

If you have an Ubuntu live CD kicking around, congratulations: you have easy access to GParted. Just boot from the disk and find GParted under “System” followed by “Administration.”

If you don’t have a Ubuntu CD, they’re easy to find. Go ahead and download an ISO or have a CD mailed to you free of charge.

If all you want is GParted, consider downloading the GParted Live CD instead. Download it and burn the ISO to disk using your burning application of choice.

Potential Uses

  • The Windows installer, particularly the XP one, tends to take forever creating partitions. Use Gparted instead to make installation faster.
  • Shrink your XP partition to make room for another OS, like Ubuntu
  • Need extra space? Remove the “Recovery” partition that came with your computer and extend your OS partition to take advantage of that extra space (but be warned, only do this if you have an OS CD on hand for re-installation.)
  • If you recently bought a bigger hard drive, you can use Clonezilla to copy your filesystem to it and then Gparted to extend your partition to the entire drive.

Conclusion

Gparted isn’t just free partitioning software; it’s the free partitioning software. If you need to rearrange your hard drive this is what you’re looking for, and it’s completely free.

Recently, my employment has me reading through a lot of blogs on pounds loss and much better wellness. A single day after examining the blogs, a neighbor saw my physical fitness picture in my husband's wallet. He desired to understand why my husband was carrying close to a picture of one more woman. I acquired transformed that a lot! I had been unrecognizable to one of our closest neighbors! That inspired me to carry up the challenge and get myself into shape. This is my story.

So, I turned to my blogs. Consistently, the blogs were saying to eat organic meals. It's like heading vegetarian but more eating things as near to nature as possible. This was fine with me; I do not like pre-packaged meals anyway.

I started eating appropriate but I nevertheless was exhausted from purchasing with my girls. So, I decided I received to include the dreaded physical exercise.

Ok, so now I've to mention I was diagnosed with breast cancer at age 32. I've not exercised since. This was a scary proposition for me and I guess soon after two years, my cancer excuse is quite worn out.

This is when I acquire up walking. I made a decision to walk 1 mile a day. There happens to become a one particular mile observe close to my home, so I do not need to do mindless laps close to a track.

The very first evening, I felt like I had been heading to die. It didn't seem like the best concept but I kept going back again. Then somewhere close to the third week, I discovered myself thinking this wasn't so poor. It was obtaining easier. I even additional an additional lap!

After all, if it took years to gain a lot of weight, to take it off safely, one need to lose weight at the same rate. By slowly changing the way you eat and workout, slow and steady weight loss will become a way of life instead of the dreaded “D” word.

If it is medically necessary for you to lose weight quickly, it must be done under a doctor's care. Bariatric surgery, for example will cause extreme weight loss due to surgery and close physician monitoring. There are a few liquid diet programs that will also work, (Oprah Winfrey did this the first time she lost weight) but it is hard to maintain such weight loss.

In addition to not working, extreme weight loss can make you very sick or even kill you. Probably one of the most famous recent cases of extreme weight loss resulting in death was Luther Van dross' yo-yo dieting and failure to control his weight related diseases. In the end, it might be wiser to stay overweight that to participate in extreme diets over and over again.
